    My RFE is with regards to Employer's ability to pay. Somehow, my employer hasn't submitted anything yet and the deadline is on Thurs Oct. 11. What will happen if we are not able to submit anything by the deadline? Will the app automatically get denied?

    Even I did not receive my AP ,which I applied last year july 2007.
    Coudn't wait anymore...its kids vacation time.I took infopass ,the IO asked me why I had not contact ed all this time.I explained to her that the constant response whenever I called the 1-800 # was 30days -60 days.

    she made us wait for almost 2 1/2 hours.
    Finally she asked to submit new application ,2 photoes,2 copies of our BCertificates.

    She gave our AP for me and my wife right away.

    So I advice you to take Info pass and check.Ap what I received was in paper.

    Thanks for the advice. I have my infopass appointment on July 23 2008. We will see.

    Thanks guys for your inputs and helping me understand this better.

    I understand that LC is for future employement. Someone said that at the time of filing 485 , company should be wiling to make you an offer for the specified location in LC. But does it just mean offer or you have to accept it and move there till it has been post 180 days of 485 submission Time when GC becomes portable (assuming 1-140 is approved).

    Took Emirate last month. the overall experience was good. Missed my flight from Dubai as the flight from JFK had to be de-iced. But Emirates arranged for my stay at Dubai and also got me a transit visa... so can't complain :) .

    But I last year I flew home by Jet and I thought the service, food, everything about the flight was really good. Would strongly recommend flying by Jet.

    Jet is not cheap anymore, they had the prices low for sake of promotion. It is very expensive now. Emirates is cheap. Thats what I am hearing. And emirates.com offers the lowest fares.

    I asked this question several times, this is what the answer I got.
    To get L-1 visa, you need to work for sister or parent company for a year outside USA. Here is the problem come.
    I am on the Same boat, How care about GC. But I care about my wife's work authorisation, she has done her Ph.D and completed her 6 year H-4 too. Even if some one offers her H-1B she cannot take up, until there is a decoupling of H-1 and H-4

    Response times are now determined by service centers. Earlier it used be be 12 weeks but now it depends on evidence type

    You'd have to wait for PD to become current to add spouse.

    Furthermore, if you get married before I-485 is approved, spouse may be added once PD becomes current, even though by then you have your GC.

    Yes, you can take "Leave without pay" - you will not be out of status. Even if you are not getting paid you still are on company payroll.

    As someone suggested earlier, if a woman on H1-B is pregnant, she can surely take maternity leave without going out of status.

    My wife's H1 is valid until 2009. We have to travel to Canada very soon and she will return on AP (EAD approved). Can she continue on H1 for the sponsoring company as it is or any amendment/filing has to be done to regain the H1 status. I dont want her to switch to EAD (just in case things go wrong down the lane)
    I read a couple of conflicting articles on this. From this link i interpret that one can continue on H1 after entering US on AP

    So did you have any other US visa in your passport, or were you carrying just AP document?

    Yeah I did have an expired H1 stamp in my passport. I also had an approved I797 (till 2010), but I did not show that.

    Its better than not going to work and sitting at home playing with your kids or watching movies or shopping at walmart or doing laundry etc etc mulling about your future if you have time to spare for a thought
    Who said the demonstrations have to be on weekday. You can very well do it on weekends and you can do it during your lunch breaks . What we lack is resolve not resources

    U will get a 3 year H1-B with the new employer.
    i donot have experience with PERM. From what i know it varies from state to state. typically 6 months, may be longer or shorter.

    I'm getting fed up with people on this forum who assume that India is the only country from which people immigrate to the US, and always only mention the India dates when talking about cut off dates, and assume that are the only dates people want to talk about.

    Even though India is by far the country of birth with the most high skilled immigrants to the US, it still takes up less than half of the number of high skilled immigrants. By some discussions going on on this forum, you would think 95% of the high skilled immigrants come from India.

    Yes you are correct. Guys just like that start some heart breaking threads. Not doing proper research on such delicate and sensitive issues.

    I know one of my friend who applied 3 different LCs thr' different employers and he finally applied thr' PERM and got approval. But his all 3 cases are still in pending queue. There might be many others who did this and together it may be quite substantial number. Of course no way to extract this kind of data.
